Who may obtain a Pistol License?

Alabama State Code 13A-11-70 et., seq. (1975) provides that the Sheriff of a county may issue a qualified or unlimited license to a person residing in the county, and is a suitable person to be licensed. Jimmy Kilgore is the Sheriff of Talladega County.

Who may not obtain a pistol license?

There are many people who cannot obtain a pistol license. Most of these are prohibited because of certain state and Federal Laws. All the Laws contained in this question are contained in the Alabama State Code and in the Gun Control Act of 1968. The people who cannot obtain a pistol license are as follows:

  1. No person who has been convicted of committing or attempting to commit a crime of violence;
  2. No person who is a Drug Addict;
  3. No person who is a habitual drunkard;
  4. No person convicted of a felony or any degree of theft;
  5. No person discharged from the armed forces under dishonorable conditions;
  6. No person who has been adjudged by a court as mentally incompetent;
  7. No citizen of the United States who has renounced his citizenship;
  8. No person convicted of the Family Violence Act, even though the charge may be a misdemeanor;
  9. No person illegally or unlawfully in the United States;
  10. No person who has been convicted of an offense involving firearms;
  11. No person who has been convicted of an offense involving explosives;
  12. No person who is not deemed suitable or proper by the Sheriff's Office.

What are the age requirements to obtain a pistol permit?

It is the policy that a license will not be issued to anyone under the age of 18.

May a Pistol License be revoked?

Yes, Title 13A-11-75 of the State Law provides that the Sheriff may revoke a license.

Is the license valid in other counties?

Yes, Title 13A-11-75 of the State Law says the license is valid within all counties of the state.

Is the license valid in other states?

Yes. In 2001, the State of Alabama passed legislation recognizing handgun licenses issued by other states provided that state would recognize Alabama's pistol license. This allows residents of the state of Alabama who have a valid pistol permit to carry their weapon in any of these states, and also authorizes persons from these states to carry a pistol in Alabama.

What is the cost of a pistol permit?

$20.00 per year

Will I be investigated if I make an application to the Talladega County Sheriff's Department for a Pistol License?

Yes, we will make an investigation.

  1. We will check to see if you have a previous arrest record.
  2. You must list two references on your application and give their physical address.
  3. We will make any other investigation as necessary.

What are the office hours for the Talladega County Sheriff's Department?

Where may I file a police report?

If you have an emergency please call 911. To report a crime that has already occured that is a non-emergency please call (256) 362-6117. A deputy will be dispatched to your location.

Can Deputy Sheriff's make traffic stops within city limits?

Yes. Deputies have jurisdiction throughout Talladega County.

Is there a "Leash Law" in Talladega County?

No. However, you may make animal complaint call to Sheriff's Office.

Who do I call to find out the status of my case after a Patrol Deputy has taken the initial report?

Normally, Felony reports are assigned to an investigator. In the North Division you may check on the status of your case by calling (256) 761-2141. In the South Division you may call (256) 245-5121. Misdemeanor cases are normally referred to the magistrate for a warrant to be issued.

Where do I pay for a traffic ticket given to me by a deputy?

First, be sure that the traffic ticket was issued by a Deputy Sheriff. City police departments have their own procedures and location for paying them. Tickets issued by Deputy Sheriff personnel may be paid at the District Clerk's Office (North/South location).

How do I obtain the release of a vehicle impounded by the Sheriff's Office?

A release for a vehicle impounded by the Sheriff's may be obtained during normal business hours at the Sheriff's North or South Office. Vehicles may be released only to the registered owner or their designated representative. Documents required at the time of the release are title or tag receipt and a current driver's license.

How do I obtain a copy of a report I filed with the Sheriff's Office?

Reports may be obtained during normal business hours, normally 8:00 a.m. to 5:00 p.m., at the Sheriff's Investigation Building or Southern Division Office. Incident/Offense Reports are free to crime victims. Arrangements may be made to have reports faxed to areas outside Talladega County by calling (256) 761-2141 during normal business hours.

When do seat belts have to be worn?

Code of Alabama, Title 32-5B-4, requires each front seat occupant of a vehicle manufactured with safety belts to have a safety belt fastened at any time the vehicle is in motion. Special exceptions to the law apply to children required to be in child safety seats, rural mail carriers, newspaper delivery, vehicles manufactured before 1965, or id in possession of a written statement from a licensed physician authorizing non-seat belt use.

What hours can I surrender myself on a warrant?

The Sheriff's Office is operational 24 hours daily.

How do I get a warrant issued?

First you must make a police report by the agency were the incident occurred. The Law Enforcement Officer that takes your report will advise you on the procedures of getting a warrant issued.

Can you tell me if you have a warrant for someone?

No. However if you have an address on where the subject is, we will gladly take the information and investigate.

Can I inquire about a warrant for my arrest via telephone?

No. If you believe there is an outstanding warrant for your arrest, it is better to go to the nearest police precinct or the Sheriff's Office to inquire.

Who can visit the Jail?

Approved family and friends may visit. Visitors must present a valid photo identification.

How can I make someone's Bond?

The approved methods for making someone's bond are cash bond, property bond, or by utilizing an approved bonding company.

Can I drop packages off at the jail for an inmate?

No packages may be dropped off at the jail for inmates. No packages, delivered by commercial delivery, will be accepted at the jail. Letters sent by U.S. Mail will be accepted for inmates as long as they do not contain money, inappropriate photographs or other contraband.

Can I leave money for an inmate?

Cash is not accepted for inmates. Money Orders are accepted. They must contain the name of the inmate and the name and address of the sender. The amount of the money order will be posted to the inmate's account on the next business day.

Can I pick up property of an inmate?

Yes, with the permission of the inmate. Person wishing to pick up the property must present picture identification and must sign a receipt for the property.

When can I visit an inmate at the jail?

Visitation is by video visitation and is during the hours of 8:00 a.m. to 11:30 a.m., 1:00 p.m. to 5:00 p.m. and 6:00 p.m. to 7:00 p.m. Monday through Friday. An inmate may have only one 30 minute visit per day.

Can inmates release money to person of their choice?

Yes.

Does the Jail have Court Dates?

No. Court date information can be obtained from the Circuit Clerk's Office or the Municipal Court Clerk's Offices.

Can Inmates use the telephone?

Yes. Telephones, provided by an inmate telephone provider, are available in each unit for use by the inmates. Calls are collect with the rates being regulated by the FCC and the Alabama Public Service Commission. The jail does not determine the rates.

How can I find out who is in Jail?

The listing of all inmates incarcerated in jail is public record. A link is available on this web-site that can be accessed to see the full list of who is currently in jail.

What is the rated capacity for the Jail?

The jail has a capacity of 485 beds with the current average daily population being approximately 330 inmates.

Can the Sheriff's Office give legal advice?

No, the Sheriff's Office can NOT provide legal advice. If you need information regarding a legal problem you should contact an attorney, local bar association, lawyer's referral service, or a legal aid organization. The Sheriff's Office can only advise and inform parties as to those procedures and rules related to the Sheriff's duties.

Can the Sheriff's Office serve at a P.O. Box?

No, you must provide a physical address including zip code.

Can the Sheriff's Office serve Out of State papers? If so what is the fee, and to who to make the cashier check or money order payable to?

Yes. The advance service fee for serving out of state papers is $50.00 residential and $100.00 to FCI of Talladega. You are to make cashier checks and money orders payable to Talladega County Sheriff's Office. The mailing address is P.O. Box 996, Talladega, AL 35161. The filing party is responsible for making sure the documents are correct and properly providing the Sheriff with a letter of instruction which shall include information sufficient to effect valid and timely service.If you would like your affidavit of service completed, please indicate so. Otherwise, we will use our affidavit of service. Of course, if you feel the individual may avoid service, a photograph is helpful but not mandatory.

Can you call me to notify me when service was made?

No. With the large volume of papers served by the sheriff's office, it would be impossible for us to notify all parties after service has been made.

I found this notice on my door and this person doesn't live here. What do I do with the notice?

It is important to understand that the Sheriff is not the only person who serves processes. Private servers and constables are also permitted to serve process. However, if you should find a document on your door for someone who doesn't live there, please call our office at (256) 362-2748. When calling us we will need some information, such as who you are and the address where the notice was left.

How can I find out if you have received my papers from the courts? If so what is the status?

Our clerical staff will be glad to assist you in answering your questions.

Do they evict you when it is raining?

No, we do not evict in inclement weather.

How do I go about getting someone evicted from my home?

First you must file an execution with Small Claims Court. Then the court will send the execution to the Sheriff's Office for process.

Can law enforcement officers talk to my child at school without asking me first?

Yes, they can. SROs are recognized by federal courts as part of school administration whose mission is to act quickly to investigate any unusual occurrences at the school. SROs most often interview students as witnesses rather than as offenders.

Isn't it the law that the school has to call me if a law enforcement officer talks to my child?

No, it is not. They frequently do call parents if a student is interviewed about a serious issue, or if the student is the victim of an offense, but they make those calls as a courtesy, not because it is the law.

Are my kids safe in school?

Students are safer in American schools than when they are not in school! Kids are most likely to be hurt or get involved in crimes when they are not in school.

Why do they keep my kids at school in bad weather?

Sometimes it is safer to keep your children at the school where there are many adults to care for them than to send them home when travel conditions are dangerous. For small children, another concern is for the care of the children if they arrive home and parents cannot get home due to the threatening weather. SROs and school leaders are always trying to make decisions that keep students in the safest environment.
